1. Acceptance and Scope

By creating an account, signing in, or using DAMSO, you agree to these Terms and our Privacy Policy.

These Terms apply to the DAMSO website, mobile features, APIs, user-generated reviews, and related services.

If you use DAMSO on behalf of an organization, you confirm you have authority to bind that organization.

2. Eligibility and Account Responsibilities

You must be legally capable of entering into a binding agreement in your jurisdiction. If local law requires parental consent for minors, you must obtain that consent.

You are responsible for keeping your credentials secure and for activity under your account.

You must provide accurate information and keep your profile information reasonably up to date.

• Do not share your password with others.
• Notify us promptly if you suspect unauthorized access.
• Do not create accounts using false identity information.

3. User Content, Reviews, and Licenses

To the fullest extent permitted by applicable law, you assign to DAMSO all transferable rights, title, and interest in content you submit to the service, including reviews, photos, comments, ratings, and related metadata.

Where assignment is not legally effective, you grant DAMSO an irrevocable, perpetual, worldwide, sublicensable, transferable, royalty-free, exclusive license to use, host, store, reproduce, modify, publish, display, distribute, and create derivative works from submitted content for service operation, safety, improvement, marketing, and legal enforcement.

You waive, to the extent permitted by law, any moral rights or similar rights that could restrict DAMSO from lawfully using submitted content under these Terms.

You represent that you have the necessary rights to upload your content and that your content does not violate law or third-party rights.

4. Community Rules and Restricted Conduct

You may not use DAMSO for unlawful, harmful, deceptive, or abusive activity.

We may remove or limit content that violates these Terms, community standards, or applicable laws.

• No defamation, hate speech, harassment, or threats.
• No spam, fake engagement, coordinated manipulation, or commercial fraud.
• No posting personal data of others without lawful basis.
• No crawling, scraping, spidering, harvesting, indexing, or automated extraction of any DAMSO content, data, metadata, listings, rankings, reviews, media, or APIs without DAMSO’s prior written consent.
• No use of bots, scripts, headless browsers, AI/LLM training pipelines, or data-mining tooling to copy, mirror, republish, or train models using DAMSO content.
• No attempts to bypass robots directives, technical controls, authentication, rate limits, or anti-abuse systems.
• No malware, unauthorized scraping, reverse engineering, or attempts to bypass security.

5. Third-Party Services and External Links

DAMSO may integrate third-party services, including map/location providers, authentication providers, and payment or analytics tools.

Your use of third-party features is subject to those third parties terms and policies.

We are not responsible for the availability or practices of third-party services outside our control.

6. Moderation, Enforcement, and Suspension

We may investigate misuse, moderate content, and enforce these Terms with or without prior notice when reasonably required.

Actions may include warning, content removal, feature restrictions, account suspension, or termination.

Where legally required, we will provide appeal or review channels for significant enforcement actions.

7. Intellectual Property

All content made available on or through DAMSO, including text, design, layout, logos, software, source/output data, photos, videos, ratings, reviews, rankings, compilations, database structure, and metadata, is owned by DAMSO and/or its licensors and protected by copyright, database right, trademark, and related laws.

Except as explicitly and lawfully permitted in writing by DAMSO, you may not copy, cache, frame, reproduce, republish, distribute, publicly display, sell, license, lease, exploit, or create derivative works from DAMSO content.

You may not remove copyright notices, watermarking, attribution labels, or proprietary legends from DAMSO materials.

DAMSO and related marks are trademarks of their respective owners.

8. Disclaimers

DAMSO is provided on an "as is" and "as available" basis to the extent permitted by law.

We do not guarantee uninterrupted service, absolute accuracy of listings, or that every review reflects your personal experience.

Location data, rankings, and recommendations may vary due to real-world changes and user submissions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DAMSO and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

Where limitation is permitted, our aggregate liability for claims related to the service is limited to the greater of CAD 100 or amounts you paid to DAMSO in the prior 12 months.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnity

You agree to indemnify and hold DAMSO harmless from claims, losses, liabilities, and costs arising from your content, your misuse of the service, or your violation of these Terms or applicable law.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ontario and federal laws of Canada applicable therein, unless mandatory consumer law in your region requires otherwise.

Before formal legal action, both parties agree to attempt good-faith resolution by written notice to the contact details in these Terms.

For users located in jurisdictions with mandatory consumer dispute rights, those statutory rights remain unaffected.

12. Changes, Severability, and Contact

We may update these Terms from time to time. Material changes will be notified through reasonable channels such as in-app notice or website update.

If any provision is unenforceable, the remaining provisions continue in effect.
